We are a RTM group for 12 flats within one block each flat comes with a garage, we have appointed a company as our managing agent. At the rear of the block is a hard standing/parking area and 12 garages which are fairly run down so as part of their brief there was 2 major works that required doing 1. - Re-furbish garages. 2. - Re-tarmacking hard standing. To cover the cost of 1. & 2. above each flat owner contributed £5,000 each , total £60,000 this was done in August 2022. 1. above was completed July/August 2023 at a cost of around £33,000. So despite numerous phone calls and emails option 2. above is still outstanding and hence they (the managing agent) still have £27,000 of our money, not only that but they have stopped communicating with us. It has got so bad that I raised a complaint against them (the managing agents) using their complaints procedure and although they acknowledged receipt of the complaint they never replied. So after getting nowhere using their in house complaint procedure I followed up by contacting the ombudsman who I have used in the past and are pretty restrictive to what they can do and as I expected that was nothing , but they did notify me to contact the Leasehold Advisory Service. So today (29/11/2024) I contacted the Leasehold Advisory Service and outlined are issues as explained above which is 3. - Our managing agent has not started part 2 of the major works despite being paid in good faith well over 2 years ago 4. - They have still around £27,000 + accrued interest of our money and are refusing to engage with us.
The Leasehold Advisory Service told me the only option open to us would be to sue the managing agent so this is where we need some help please
